Booking Conditions
Before you book
A few things worth knowing before you choose your dates.
Rates
Rates are quoted per room per night and include breakfast, VAT at 10% and the Balearic tourist tax. Nothing is added at check-out except what you order during your stay.
Rates move with demand and availability. Anything quoted before confirmation is indicative; the rate becomes binding when we confirm your booking in writing.
Adults only
We welcome guests aged 18 and above. This applies without exception, so please take it into account when booking — we cannot accommodate younger guests on arrival, and a booking cancelled for this reason falls under the normal cancellation terms.
Animals on the property
Cats and a dog live here; they are part of the place. We also welcome guest dogs. If you have a relevant allergy or phobia, this is not the right house for you, and we would rather say so now than at check-in.
You are welcome to bring one dog per room, up to 10 kg, by prior arrangement, and no more than two dogs in the house at any time — so please do let us know in advance. They should be comfortable around cats. €25 per dog per night, food not included.
Payment
Individual bookings: 50% on booking, the balance 14 days before arrival.
Group bookings of three rooms or more: 50% on booking, the balance 60 days before arrival.
The balance is charged automatically to the card you provided. Bookings made through Booking.com or another travel platform follow that platform’s terms, which are set out in your confirmation from them.
Cancellation
Individual bookings
— Free of charge: received no later than 29 days before arrival
— 50% of total: 28 to 15 days before arrival
— 100% of total: 14 days or fewer before arrival, and no-shows
Groups, 3–5 rooms
— Free of charge: received no later than 91 days before arrival
— 50% of total: 90 to 61 days before arrival
— 100% of total: 60 days or fewer before arrival
Groups, 6+ rooms
— Free of charge: no free cancellation — 25% of the total (half the deposit) is non-refundable
— 50% of total: 90 to 61 days before arrival
— 100% of total: 60 days or fewer before arrival
For groups, reducing the number of rooms counts as a cancellation of those rooms. Discounted rates are non-refundable and are marked as such before you book. Cancellations must be in writing.
We cannot cover costs arising from cancelled flights, travel restrictions or other circumstances outside our control, so we do recommend travel insurance.
Arrival and departure
Check-in from 15:00, or from 16:00 for groups of three rooms or more. Check-out by 12:00.
Early check-in and late check-out are subject to availability and are never automatic — they only apply once we have confirmed them. Until your room is ready we cannot promise a sun lounger, breakfast or lunch, and when the house is full an early arrival may mean waiting. The surest way to have the room early or leave late is to book the night before or after. Staying in the room past 12:00 without this having been agreed is charged at 50% of the daily room rate until 15:00 and the full rate thereafter.
A valid passport or national identity card is required at check-in. Driving licences cannot be accepted — Spanish law requires us to register the document with the authorities, and a licence does not qualify.
Gift vouchers
Vouchers bought through our website are redeemed against your deposit. If the voucher does not cover the deposit in full, the remainder is payable as usual; anything left over stays as credit for extras during your stay. Email us at reservations@legado-ibiza.com with your code and preferred dates and we will arrange the rest. You may withdraw from a voucher purchase within 14 days of receiving it, unless it has already been redeemed.
General Terms and Conditions
1 · Scope
These General Terms and Conditions govern all contracts concluded with Lackner Oberkanins SL, trading as Finca Legado Ibiza, for the rental of hotel rooms and for related services. They apply from the moment a booking is confirmed.
Where the Booking Conditions set out above summarise a provision of these Terms, the two are intended to say the same thing. Should a summary and the corresponding provision differ, whichever is more favourable to the guest applies.
2 · Formation of contract
The contract is concluded when your booking request is confirmed in writing, including by email. The contracting parties are the hotel and the guest.
Where a third party books on behalf of a guest, that third party and the guest are jointly liable to the hotel, provided the third party has confirmed the booking to us in writing.
3 · Rates, taxes and price changes
Rates are quoted per room per night and include breakfast, VAT at the applicable rate (currently 10%) and the Balearic tourist tax (Impuesto sobre Estancias Turísticas).
Rates vary with demand and availability. Rates quoted before confirmation are indicative and become binding only on written confirmation.
Where more than twelve months pass between confirmation and arrival and our rates have risen in the meantime, we may adjust the agreed rate by up to 10%. We will notify you in writing of any such adjustment and of the reason for it, at the latest 30 days before it takes effect. You may cancel the booking free of charge within 14 days of that notice.
Rates may also be adjusted where you request a change to the number of rooms, the dates, the length of stay or other services, and we agree to it.
4 · Payment
For individual bookings a deposit of 50% is due on booking and the balance 14 days before arrival. For group bookings of three rooms or more the deposit is 50% on booking and the balance is due 60 days before arrival. We always require a valid credit card as security.
Where a payment deadline passes without payment, we will contact you and allow a reasonable period to settle. If payment is still not made within that period, we may cancel the booking; the cancellation terms in clause 6 then apply as at the date of cancellation.
Invoices without a stated due date are payable within seven days. Payment is accepted in euro. Charges levied by your own bank are yours to bear. Late payment attracts statutory interest.
Bookings made through online travel platforms may be subject to that platform’s payment and cancellation terms, as set out in the confirmation issued by the platform.
5 · Rooms and use
You are entitled to a room of the category booked, not to a specific room. We may allocate a room of a higher category at no extra charge.
Rooms are available from 15:00 on the day of arrival, and from 16:00 for group bookings of three rooms or more. Rooms must be vacated by 12:00 on the day of departure.
Where a room is occupied beyond 12:00 without a late check-out having been agreed, we charge 50% of the daily room rate until 15:00 and 100% thereafter. Early check-in and late check-out can only be guaranteed by booking the preceding or following night. Luggage storage is available.
Where belongings are left in a room after the departure time, we may pack and store them. We will keep them safe and notify you.
Each guest receives a room key and a remote control for the entrance gate. Where these are lost or not returned, we charge €50 per set, being our cost of replacement. You may show that the actual cost was lower, in which case we charge the lower amount.
Subletting a room, letting it on, or using it for anything other than accommodation requires our prior written consent.
6 · Cancellation by the guest
Cancellations must be made in writing and take effect when we receive them. Where we have granted a right to cancel free of charge by a given date, the cancellation must reach us before that date.
Timing is counted from the arrival date, which counts as day zero. A cancellation takes effect on the day the hotel receives it in writing.
Individual bookings: free of charge where the cancellation is received no later than 29 days before arrival; 50% of the total booking value where received 28 to 15 days before arrival; 100% where received 14 days or fewer before arrival, and in the case of a no-show.
Group bookings of three to five rooms: free of charge where received no later than 91 days before arrival; 50% where received 90 to 61 days before arrival; 100% where received 60 days or fewer before arrival.
Group bookings of six rooms or more: for these bookings there is no free-cancellation period. An amount equal to 25% of the total booking value — that is, half of the 50% deposit paid on booking — is non-refundable from the outset. Thereafter, 50% of the total is due where the cancellation is received 90 to 61 days before arrival, and 100% where received 60 days or fewer before arrival.
For group bookings, a reduction in the number of rooms is treated as a cancellation of the rooms concerned.
Rates sold at a discount are non-refundable where this was stated at the time of booking. Promotion codes are personal and may not be transferred without our consent.
In the event of a no-show or an early departure, the full booking value remains payable.
We cannot accept liability for costs arising from flight disruption, travel restrictions in your country of origin or destination, or other third-party circumstances beyond our control. We recommend comprehensive travel insurance.
7 · Cancellation by the hotel
We may terminate the contract where:
— materially false or misleading information was given when booking;
— there are substantiated grounds to believe the stay would endanger the safe operation of the hotel, the safety of guests or staff, or the reputation of the house;
— a room is sublet or used for a purpose other than accommodation without our consent;
— payment is overdue and not made despite a reasonable period having been allowed;
— the House Rules are breached seriously or repeatedly, and the breach continues after we have asked for it to stop.
Where we terminate on these grounds, we retain the amount corresponding to the services already provided and to the loss we actually incur. We do not retain more than that.
Where we are unable to provide the booked accommodation for reasons outside our control — natural events, official measures, failure of essential infrastructure, industrial action or comparable circumstances — we will tell you as soon as we can and offer alternative dates or a voucher. You may instead ask for a refund of amounts already paid for services not provided.
8 · House Rules
Our Guest Information and House Rules, published at legado-ibiza.com/guest-information and available in every room, form part of these Terms. They cover the use of the pool and common areas, quiet hours, housekeeping, towels, waste separation, keys, visitors and fire safety. By booking, you accept them.
Where the House Rules provide for a charge — additional cleaning after smoking in a room, the cost of a false fire alarm caused by smoking, or comparable cases — that charge represents our estimate of the loss typically arising. You may show that no loss arose or that it was lower, in which case we charge accordingly or not at all.
9 · Liability
We are liable without limitation for damage arising from injury to life, body or health, and for damage caused intentionally or through negligence, in accordance with Spanish law.
Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited towards a consumer.
Under Spanish law, the belongings you bring into the hotel are treated as a special form of deposit (Articles 1783 and 1784 of the Código Civil). In plain terms: we are responsible for your belongings — including against theft by others — provided you have made us aware of them and have followed the precautions we ask of you. This responsibility does not extend to armed robbery or to events beyond anyone’s control.
So that this works as intended, please use the hotel safe (available through reception) for small amounts of cash, jewellery, watches and other valuables, and ask us for a receipt when you deposit them. We recommend against leaving valuables unattended in rooms, vehicles or unsecured areas; where something is lost because it was not deposited despite this, our responsibility is reduced or excluded accordingly.
We may decline to take into safekeeping items of exceptional value, or items whose custody would be unreasonable for a house of our size. Where we decline custody, we do not answer for those items.
Please report any damage or defect to us as soon as you notice it, so that we can put it right.
Wi-Fi is provided within the limits of what is technically possible at the property. We cannot guarantee a minimum bandwidth, but we will keep interruptions as short as we can.
10 · Lost property
Items left behind are kept for six months and forwarded on request, at your risk and expense. After six months, we may dispose of them.
11 · Gift vouchers
Vouchers are redeemable against accommodation and services provided directly by Finca Legado Ibiza, subject to availability and at the rates applying at the time of booking. To redeem, email your voucher code to reservations@legado-ibiza.com. The voucher value is set against your deposit or the total booking value; any part of the deposit not covered remains payable as usual.
A voucher does not entitle the holder to particular dates, room categories or rates.
Purchased vouchers are redeemed in full against a single booking. Where the voucher value exceeds the booking value, the surplus remains available as credit for services during that stay and is settled at departure; it is not paid out in cash and does not carry over to a future stay.
Vouchers are transferable. There is no contractual expiry date; the statutory limitation period of five years from issue applies (Art. 1964.2 Código Civil).
You may withdraw from a voucher purchase within 14 days of receiving it, unless it has already been redeemed.
Vouchers issued by us as a gesture of goodwill rather than sold may be redeemed in part, carry a stated expiry date, and are otherwise subject to the same conditions.
12 · Data protection
We process personal data in accordance with the GDPR and Spanish data protection law. How we do so is set out in our Privacy Policy at legado-ibiza.com/privacy. Payments are processed over encrypted connections.
13 · Complaints and dispute resolution
If something is not right, please tell us — reservations@legado-ibiza.com or the front desk. Most things are quickest to fix while you are still here.
Consumers resident in the European Union may also use the European Commission’s online dispute resolution platform at https://ec.europa.eu/consumers/odr.
14 · Final provisions
Spanish law applies. The place of performance is Santa Eulària des Riu, Illes Balears. Where the guest is a consumer, jurisdiction follows the mandatory rules of consumer law; in all other cases the courts of Ibiza have jurisdiction.
These Terms are published in English and Spanish. In the event of any discrepancy between the versions, the Spanish version prevails.
Should any provision be or become invalid, the remaining provisions are unaffected.
