BOOKING INFORMATION

RATES:

Rates are per room per night including breakfast and all taxes (10% VAT and tourist tax).
 

PAYMENT:

Individual bookings: 50% down payment on booking, 50% balance 14 days prior to check in.
Group bookings (3 or more rooms): 50% down payment on booking, 50% balance 60 days prior to check in.
Other conditions may apply for OTA bookings (booking.com etc.), you will find these on your respective booking confirmation.
 

CANCELLATION POLICY:

Individual bookings: Free cancellation up to 28 days, 50% cancellation fee up to 14 days and 100% cancellation fee within 14 days prior to day of check in.
Group bookings (3 - 5 rooms): free cancellation up to 90 days, 50% cancellation fee up to 60 days and 100% within 60 days prior to check-in.
Group bookings (6 or more rooms): 25% cancellation fee up to 90 days prior to check-in (non-refundable deposit). 50% cancellation fee up to 60 days and 100% within 60 days prior to check-in.
Other conditions may apply for OTA bookings (booking.com etc.), you will find these on your respective booking confirmation.
Discounted bookings are non-refundable. Please note that promotion codes are personal and cannot be extended or transferred to third parties without the explicit consent of the advertiser.

Finca Legado cannot be made liable for cancellation fees, which arise from cancellation of flights, any kind of travel restrictions to which travel from your region may be subject or any other circumstances that are third party responsibility. We strongly recommend obtaining appropriate travel insurance.
 

SMOKING

All rooms are non-smoking room. Failure to comply will result in an additional cleaning fee being charged.
 

ADULTS-ONLY:

Only guests aged 18 and older can be accommodated.
Guests under 18 years of age may be denied a stay without entitlement to free cancellation. 
 

CHECK-IN:

An official photo ID (passport or ID card) is required for check-in, unfortunately a driver's licence does not qualify as such.

COMPANY INVOICE:

If you require a company invoice to an invoice address other than the booking address, please let us know at the latest at checkout. In this case, we need the correct company name, the postal address and, if applicable, the VAT number. Unfortunately, invoices cannot be changed once they have been issued.
 

ANIMALS:

Cats and dogs are living at the property. If you suffer from relevant phobias or allergies, we kindly ask you to refrain from booking. Cancellations at short notice due to allergic reactions cannot be accepted.


 

GENERAL TERMS & CONDITIONS (GTC)

Scope of application

1. These General Terms and Conditions apply to contracts for the rental of hotel rooms for accommodation, as well as all other services and deliveries (hereinafter referred to as "service provision") provided to the customer by the operating company (hereinafter referred to as "hotel").

2. A hotel accommodation contract (hereinafter referred to as "contract") is concluded upon the customer's booking enquiry with a corresponding booking confirmation from the hotel.
 

Conclusion of contract, partners

1. Offers made by the hotel are non-binding. The contract is concluded upon acceptance of the customer's request by the hotel, expressed by a booking confirmation in written form.

2. The contractual partners are the hotel and the guest / customer. If a third party has booked on behalf of the customer, it shall be liable to the hotel together with the customer as joint and several debtor for all obligations arising from the hotel accommodation contract, provided that the hotel has received a corresponding declaration from the third party.
 

Subletting, type of use

The subletting or re-letting of the hotel rooms provided requires the prior consent of the hotel in text form.
 

Room provision, handover and return

1. The customer is not entitled to the provision of specific rooms within the booked category. If a room in the booked category is not available, the hotel can upgrade the customer to a higher category without further enquiry.

2. Booked rooms are available to the customer from 3 pm on the agreed day of arrival (check-in time). For groups (from 3 rooms or more) the rooms are available from 4 pm (group check-in time). The customer is not entitled to earlier availability.

3. On the day of departure, the rooms must be vacated by 12 noon at the latest (check-out time). If the rooms are not vacated on time, the hotel may charge 50% of the room rate for the additional use of the room until 3 p.m. and 100% of the current daily room rate from 3 p.m. onwards.
If the customer is not on site at the agreed check-out time, the hotel reserves the right to pack the items left in the room by the guest and store them for the guest until the guest returns.
None of this shall give rise to any contractual claims between the hotel and the customer.

4. Early arrival and late departure:  If the customer arrives early in the day and wishes to have immediate access to the room before the regular check-in time, the hotel recommends that the previous night is also booked in order to guarantee immediate access.
Similarly, in the event of a late departure, the customer is guaranteed access to the room if the following night is booked. If no further nights are booked, the luggage can be stored for the customer.
 

House rules

The hotel's house rules are summarised in the guest information and form an integral part of the general terms and conditions. By concluding the contract, i.e. making the booking, the guest accepts the GTC and the house rules as the contractual basis for the booked stay.
Non-compliance can therefore be considered a breach of contract and may result in the refusal of further hospitality and the exclusion of the guest from the hotel. In the event of such exclusion due to breach of contract, the hotel is not obliged to pay any compensation.
 

Services and prices

1. The hotel is obliged to keep the rooms booked by the customer available and to provide the agreed services.

2. The customer is obliged to pay the hotel's applicable or agreed prices for the provision of rooms and other services utilised by the customer. This also applies to services and expenses of the hotel to third parties arranged by the customer.

3. The agreed prices include the applicable statutory VAT. Local taxes, e.g. the tourism tax, are also included in the agreed prices. With regard to contracts with non-private customers, the hotel reserves the right to state or agree net prices.

4. If the period between the conclusion of the contract and the hotel stay exceeds 12 months and the price generally charged by the hotel for its services increases, the contractually agreed price may be increased appropriately, but by no more than 10%.

5. The prices may also be changed by the hotel if the customer subsequently requests changes to the number of rooms booked, the hotel's services or the dates or duration of the guests' stay and the hotel agrees to this in principle.

6. Changes in the VAT rate do not automatically lead to a change in prices. Equalisation of the additional or reduced VAT burden between the parties is excluded.

7. All prices and services quoted refer to 2 persons for double rooms and 4 persons for quadruple rooms. Price reductions due to occupancy with less than the maximum number of guests are excluded. Dogs with up to 10kg can be accommodated on request, a separate fee will be charged during check-out.

8. The customer receives a booking confirmation by e-mail with a booking number (it is recommended to keep this number) and all booking details.

9. Extensions of stay must be treated as a new reservation for the dates requested and are subject to room availability and current rates. The room rate is subject to change.

10. The customer is fully liable to the hotel for damage to the building and inventory caused by himself, his vicarious agents or his guests, unless he can prove that no damage has occurred. This also applies to costs caused by excessive wear and tear or soiling of the hotel rooms.

Payment and offsetting

1. The hotel is entitled to demand advance payments or security deposits at any time, for example in the form of a credit card guarantee or deposit.

2. The hotel places the highest demands on the security of personal data. The booking system and the payment provider encrypt credit card details according to the highest technical standards so that this information cannot be read while it is being sent over the Internet.

3. If, in exceptional cases, no advance payment or payment on site has been agreed or made, invoices of the hotel without a due date are payable without deduction within 7 days of receipt of the invoice. The hotel is entitled to declare accrued receivables due at any time and to demand immediate payment. In the event of late payment, the hotel is entitled to charge the applicable statutory default interest.

4. Settlement shall be made in the EURO currency. In the event of payment with foreign means of payment, the exchange rate differences and bank charges shall be borne by the party obliged to pay.

5. The customer may only offset undisputed or legally established claims against claims of the hotel.

6. The hotel has a lien on all items brought into the hotel by the customer for its claims.
 

No-show / withdrawal / cancellation by the customer

1. Amendments, additions or cancellations to the contract, the acceptance of the application or these terms and conditions for overnight stays should be made in text form. Unilateral amendments or additions by the customer are invalid.

2. Cancellation by the customer of the contract concluded with the hotel requires the hotel's consent in text form.

3. For rented hotel rooms, subject to No. 4, the agreed fee must be paid even if the agreement pursuant to No. 1 is not given, the booking is cancelled by the customer or the customer does not appear. In the event of cancellation subject to No. 4, the customer is obliged to pay 100% of the contractually agreed price for the stay.

4. If the hotel and the customer have agreed in writing on a date for a cost-free cancellation of the contract, the customer may cancel the contract up to that date without incurring payment or damage compensation claims by the hotel. The customer's right of cancellation shall expire if he does not exercise his right of cancellation in text form vis-à-vis the hotel by the agreed date and the hotel has confirmed receipt of the cancellation in text form.
 

Cancellation of the hotel

1. If the customer's right to cancel the contract free of charge within a certain period has been agreed in writing, the hotel is entitled to cancel the contract during this period if there are enquiries from other customers for the contractually booked hotel rooms and the customer does not waive his right of cancellation upon enquiry by the hotel. This applies accordingly if an option is granted, if other enquiries are received and the customer has not confirmed the booking by providing his credit card details and making a deposit payment.

2. If and to the extent that advance payments have been agreed with the customer and the customer fails to make such payments within a grace period set by the hotel with a warning of refusal, the hotel shall be entitled to withdraw from the contract.

3. Furthermore, the hotel is entitled to withdraw from the contract for objectively justified reasons, for example if

• a. force majeure or other circumstances for which the hotel is not responsible that make it impossible to fulfil the contract (such as strike or power failure);
• b. rooms or events are booked under misleading or false statements of material facts, e.g. regarding the person of the guest or the purpose;
• c. the hotel has reasonable grounds to believe that the use of the hotel's services may jeopardise the smooth operation of the hotel, its security or public reputation, without this being attributable to the hotel's sphere of control or organisation;
• d. the purpose or reason for the stay is unlawful;
• e. the customer sublets or re-lets the rooms provided or uses them for purposes other than accommodation without the prior consent of the hotel;
• f. there is a violation of the house rules.

4. The right of the hotel to claim damages shall not be affected by the cancellation.

5. In the event of justified cancellation by the hotel, the customer shall have no claim to compensation.
 

General liability of the hotel; limitation period

1. The hotel's liability for its own fault and the fault of its vicarious agents - regardless of the legal grounds - is limited to intent and gross negligence.

2. Should disruptions or defects occur in the hotel's services, the hotel shall endeavour to remedy such upon knowledge thereof or upon immediate complaint by the customer. The customer is obliged to make reasonable efforts to remedy the disruption and minimise any possible damage. In addition, the customer is obliged to inform the hotel in good time of the possibility of exceptionally high damages.

3. Any items carried by the customer are at the customer's risk in the hotel. The hotel accepts no liability or duty of care for loss, destruction or damage, except in cases of intent or gross negligence.

4. Money, securities and valuables can be stored in the hotel safe up to a maximum value of EUR 800.00 to be covered by the hotel's insurance upon proof of value. The hotel recommends that the customer makes use of this option.

5. Insofar as the customer is provided with a parking space in a hotel car park - whether free of charge or for a fee - this does not constitute a safekeeping agreement. The hotel is not liable for loss of or damage to the vehicle or its contents, except in cases of intent or gross negligence.

6. Messages, post and consignments of goods for the customer are handled with care. The hotel shall only undertake delivery, storage and forwarding at the request, risk and expense of the customer. Claims for damages that are not based on intent or gross negligence are excluded.

7. The limitation period for customer claims of any kind is one year.
 

Lost property

Items left behind will only be forwarded at the request, risk and expense of the customer. The hotel will keep items left behind for six months. After this time, the finder acquires ownership of the item if the authorised party has neither become known nor the authorised party has registered their right.
 

Consumer arbitration board

The hotel is generally not willing and not obliged to participate in dispute resolution proceedings before a consumer arbitration board.
 

Vouchers

1. Scope of validity and guest information: The voucher entitles the holder to redeem
it for all services offered by the hotel. It is not possible to redeem the voucher for third-party services that can be consumed at the hotel.

2. Redeem the voucher:

• a. Vouchers are non-transferable. Vouchers may only be redeemed by the person named on the voucher.
• b. Vouchers are valid for 1 year after issue and can be redeemed during this period on request and subject to availability.
• c. The voucher can only be redeemed in one amount in total. There is no entitlement to a cash payment, a credit note, a refund or a new voucher.
• d. The voucher number must be given when booking.
• e. If the booked service is not used, the hotel reserves the right to offset the no-show against the voucher. The voucher therefore expires.

3. Warranty: The hotel accepts no liability for the loss or theft of vouchers.
 

Final provisions

1. The place of fulfilment and payment is the hotel's registered office.

2. The exclusive place of jurisdiction - also for disputes relating to cheques and bills of exchange - in commercial transactions is the registered office of the hotel.

3. Spanish law applies.

4. Should individual provisions of these General Terms and Conditions be invalid or void, this shall not affect the validity of the remaining provisions. In all other respects, the statutory provisions shall apply.
